Enforcement notice a nullity due to bat presence

An enforcement notice which required the demolition of a house at a former fish farm in Surrey as part of a landscaping scheme prior to the occupation of a new dwelling on the site was quashed after an inspector found it to be a nullity due to the presence of bats.
