Legal Comment: Morge ruling set to influence decisions

The courts have been mulling over R (Morge) v Hampshire County Council, which raises the vexed question of wildlife impacts. Vivienne Morge, a local resident, sought to quash planning permission for a new bus transit route along an old railway line on the grounds that it would disturb bats and badgers and have a serious adverse impact on biodiversity.
